Latitude at Vista Ridge (“Latitude”) is a single-family home HOA consisting of 124 separate homes, each owned in fee by members of the HOA. Each homeowner is responsible for maintenance and repair of their yards and homes. Nothing in the Declarations requires the HOA to repair or maintain anything that is not a common element in Latitude. As this case has developed, the court has issued orders concerning CCIOA’s scope in relation to standing of the HOA to bring the claims on behalf of individual homeowners, the defense side has discussed whether each individual homeowner should be added as a party to the action, and issues concerning whether the HOA provided proper notice to its members as to the defects being asserted and the expenses that may be incurred by the HOA in proceeding with the CD case under the amended provisions of CCIOA.
This CLE will explore all of these issues and more as we talk about how best to defend this new approach to CD litigation and suggest ways to preserve issues for appeal. The CLE will encourage discussion of these issues and suggest strategies for defending similar actions moving forward.
