The homeowner’s association sued the builder and developer; both of whom sued numerous subcontractors including Lucero Concrete. The HOA was seeking several million dollars for repairs to the condominium buildings’ façade, firewalls, roofs, sidewalks, and underground garages. The allegations related to Lucero’s work involved the lack of a consistent and adequate drainage slope in the underground garages. At the conclusion of a five-week arbitration, the arbitrator determined that Lucero was not liable for any of the claimed damages. Lucero was awarded its litigation costs as a consequence of receiving a defense award.
