The defense of an obstetrician often involves unique and extraordinary issues of sympathy and monetary risk. Nonetheless, this case was defended through to a verdict in favor of our client who steadfastly believed that he provided appropriate care and treatment to this expectant mother. Michael Drew and David Karr defended this case for three weeks to an El Paso County District Court Jury. Despite the obvious empathy for a severely brain damaged child who had medical care and financial needs projected over his life time to cost in the range of $8 million, the defense was able to communicate a sophisticated, medically based defense, utilizing the expertise of several well known specialists and a world renowned expert in the field of pregnancy induced hypertension. Once the verdict was entered in favor of our client, several jurors visited with him, hugged him, and assured him that they believed in his work and treatment of the patient, a testament to his own conviction and the quality of his defense.

An eight year old with substantial brain damage and cerebral palsy claimed that our client provided substandard obsetrical care to his mother during the pregnancy resulting in severe hypoxic ischemic encephalopathy. Through his parents, the child claimed ceonomic damages in excess of $14 million, $12 million more than the physician’s liability coverage. Mr. Drew and Mr. Karr presented an impressive set of experts to address each of the issues raised, including the world’s leading expert on hypertension in pregnancy, with over 300 peer reviewed articles, book chapters and publications in the medical literature. The jury returned a defense verdict after three weeks of evidence.
